Terms of Service.

General Terms

All relevant reference material and requirements should be provided before any work begins or payment is submitted.

Clear communication is required for accurate interpretation of your request.

You, as the client, must be 18+ for commissions relating to mature themes.

Failure to abide by terms outlined may result in the commission being declined or canceled.

I, as the artist, have every right to decline your commission request for any reason.

Additional Information!!I have very severe aphantasia, meaning I do not have the ability to picture anything in my little brain.

So please, please include as many references of things you can think of.Can't find references? Let me know and I'll sit down with you before we start the piece, and I'll help you find images that fit with what you are imagining!^{Poses, Facial Features, Scars, Expressions, Palettes, Inspirations, anything and everything you can think of.}I want to be able to bring your commission to life the way you envision it.
I do not know your characters as well as you do, and heavily rely on your vision to work!

Payment Policies

Payment Method: VGen, PayPal or Kofi
Currency: USD

As PayPal now accepts Crypto Currencies, I must state I DO NOT accept this form of payment and will blacklist you if you attempt to pay me in such a form.

Commissions can be paid 100% upfront or 50% upfront, and 50% for the final piece.I will not continue the commission until the payment is securely in my PayPal account.

I will not send you the final commission until after you have paid the commission price in full. If you do not have the funds when I finish the given piece, I will wait 2 weeks for you to send the rest.

Payment Plans
For orders over $100 we can set a plan to finish the payment.I offer weekly to monthly plans, which can be done through VGEN preferably. Additionally, through PayPal Invoice.
More can be discussed in private messages to find what works for you, as the client.You will not receive the final work until the payment has been paid in full.What does a Payment Plan mean?
Depending on the level of commission you purchase, we'll break it down into sections for the payment.

This is susceptible to changes depending on the level of commission, and the clients budget.Strike System

Strike I: After the first failure of not being able to pay on time within your payment plan. I will reduce the timeframe from 1 week to 5 days.Strike II: By the second failure of not being able to pay on time within your payment plan. I will reduce the timeframe from 5 days to 24 hrs.Strike III: The commission will be concluded and all rights that would have been bestowed in relation to the artwork will be retracted.

You will not receive the final work, as well as be put on a personal blacklist.

Commissions Process

After 100% or 50% of the payment has been sent, I will begin sketches of the request. Once the sketch has been approved, I'll begin cleaning it up and send it again for further approval.^{Any sketches that are rejected can be used for future projects.}I tend to update the client a lot throughout the process. If you do not want several updates, please let me know.

Based on the complexity of your commission there is a possibility there will be additional fees. All fees are listed in Prices.Depending on the level of commission you are asking for, I will begin laying out colors and proceed with rendering.Commissions are generally expected to take 1 to 3 weeks from full payment to complete.^{If there are any circumstances that delay commission completion, you, as the client, will be informed.}

Refund Policies

For any reason I am unable to finish your commission due to life situations, I will refund you the amount sent at the time.I do not accept refunds after you've approved of the sketch.If you, as the client, ceases contact for 31 days, the commission will be considered concluded, and no refunds will be issued.Forcing a chargeback will result in personal and public blacklisting. All rights that may have been bestowed in relation to the artwork will be retracted and appropriate legal action may be taken.

Revision Policies

The subject of the commission cannot be changed after the payment has been submitted.A maximum of 4 revisions are given during the sketch stage free of chargeFurther revisions will result in fees proportional to the additional workload. Depending on how far into the process I am into the commissioned piece, as well as how large of an edit you are asking for, will dictate how high the fee will be.

If you have given me, as the artist, "Artistic Freedom" with your commission request. You are not allowed to majorly change the pose after approval.Major Edits
This includes moving several parts to the pose, how the characters are interacting, etc.Minor Edits
This includes resizing, color edits, small jewelry details, etc.

No revisions will be made once the commission is considered complete.Corrections to the accuracy of the OC(s)/Character(s) will always be acceptable and will NOT count towards revisions.

Rush Order Policies

Turnaround TimeThe time will vary between 1 to 3 weeks from the beginning of your commission. Depending on workload/life situations it may take longer.If you have a preferred deadline, let me know during your commission request.I require at least 1 week ahead of time for Rush Orders.^{There will also be a fee on top of your commission price for Rush Orders. Trusted Client Reward System

Discounts
For clients that have commissioned 5 successful pieces, there will be a 10% discount as appreciation.On your 6th commission specifically, the discount will be accessible.Payment Plans
For clients that have commissioned 3 successful pieces, payment plan options are increased. For all commissions moving forward, if a trusted client wanted to use a Payment Plan. The price will be lowered from $100 to $50 to set up a plan.

Copyright + Usage Policies

Under no circumstances may the artists signature ^(@Minkio) be removed from any artwork.Additionally, under no circumstances may commissioned pieces, or any of the Artists' ^(@Minkio) works are to be used in; NFTs or AI generating programs. I, as the Artist ^(@Minkio) do not condone these actions. Do not use my work for NFTs or AI.Art may not be modified or edited by anyone but the original artist ^(@Minkio).When reposting artwork you have purchased to your own galleries, you must use the watermarked version provided, and link back to this Carrd or the artists Bluesky.The artist ^(@Minkio) reserves full rights to the work produced. This means the artist ^(@Minkio) owns the image of the commission.
^{If the client has paid for Private Fees, under no circumstances may the artist post the work to social media or use related commission in portfolios.}^{Commissions are both Personal Use and Commercial Use.}
When purchasing Commercial Rights, the artist ^(@Minkio) still owns the rights to the image. With you, as the client, owning a license to use related image.Under no circumstances may the artist ^(@Minkio) make monetized content of the related commission when a Commercial License has been purchased for the related artwork.^{Commercial Rights Fees are listed in Prices.}Under no circumstances may personal, non-commercial art be used for the purposes of making or promoting monetized content by anyone but the original artist ^(@Minkio). Unless the client has paid for Private Fees, then the commissioned piece is not allowed to be used on the artist's ^(@Minkio) social media or portfolio.

COMPLEX DESIGN FEES
For Complex designs, extra 50%

We can discuss whether or not your design is complex before going forward.

COMMERCIAL RIGHT FEES
For Commercial Licenses, the price of the license will be on top of the commission price, unless stated otherwise.

These licenses are 50%-100% ON TOP of your commission price.

PRIVATE FEES
For private commissions with no posting to social media there will be a 30% fee ON TOP of your commission price.

DEADLINE FEES
For orders with a due date
there will be a 30% fee ON TOP of your commission price.^{(Deadline fees only apply when there is less than a month of given time to finish.)}

REVISION FEES
For edits after the 4th change there will be a fee ON TOP of your commission price. Listed below...
